Return & Refund Policy
Important Notice: By completing a purchase with BlueDiesel, the Buyer acknowledges that it has independently verified the suitability of the product(s) for its intended application prior to placing the order. BlueDiesel does not accept returns or issue refunds on the basis of product incompatibility or unsuitability unless a verified quality defect is established.
1. Scope and Application
This Return & Refund Policy applies to all commercial transactions between BlueDiesel (“the Company”, “we”, “us”) and the purchasing party (“the Buyer”, “you”). All sales are conducted on a business-to-business (B2B) basis. The Company does not transact with retail consumers under the Consumer Protection Act 1999.
2. Buyer’s Responsibility to Verify
Prior to placing any order, the Buyer is solely responsible for:
- Confirming that the product(s) ordered are compatible with its equipment, vehicles, or systems;
- Verifying that the specification, grade, concentration, and packaging format meet its operational requirements;
- Ensuring that applicable regulatory or manufacturer requirements are satisfied for its intended use;
- Reviewing all product documentation, safety data sheets (SDS), and technical specifications made available by the Company.
The Company provides product information in good faith but makes no representation or guarantee that any product is suitable for the Buyer’s specific application. Reliance on any such information is at the Buyer’s own risk.
3. No Returns Accepted — General Rule
As a general rule, all sales are final. The Company does not accept returns of products once goods have been delivered and accepted by the Buyer. This policy reflects the nature of the products (chemical fluids and industrial compounds) and the costs associated with handling, storage, and re-qualification.
Returns will not be accepted for any of the following reasons:
- Change of mind or cancellation after delivery;
- Ordering the wrong product, quantity, or packaging format;
- Product incompatibility with the Buyer’s equipment, vehicles, or systems;
- Failure to use the product within the recommended storage period or conditions;
- Improper storage, handling, or contamination after delivery;
- Circumstances arising from the Buyer’s failure to verify suitability prior to purchase.
4. Limited Exceptions — When a Return May Be Considered
The Company may, at its sole discretion, consider a return or replacement only under the following strictly limited circumstances:
- Wrong product delivered: The Company delivered a product materially different from what was confirmed in the purchase order;
- Short delivery: The quantity delivered is measurably less than the confirmed order quantity; or
- Verified product defect: The product is found, upon independent testing at a recognised laboratory, to deviate from its stated specification (e.g. ISO 22241 for AUS32 AdBlue®).
All exceptions are subject to the conditions in Section 5 below.
5. Conditions for Return Requests
To be eligible for consideration under Section 4, the Buyer must:
- Notify the Company in writing (via email to [email protected]) within 48 hours of delivery;
- Provide documentary evidence including the original delivery order, photographs of the product, packaging, and any visible damage or discrepancy;
- Keep the product in its original, unopened, and uncontaminated state in appropriate storage conditions pending inspection;
- Allow the Company or its appointed representative to inspect the product prior to any return being authorised;
- Provide test reports from an accredited laboratory where a quality defect is alleged.
Any return request submitted outside the 48-hour window, or where the product has been opened, used, diluted, mixed, or stored incorrectly, will not be entertained.
6. No Refunds on Opened or Used Products
Absolutely no refund or credit will be issued for any product that has been:
- Opened, dispensed, or used in any quantity;
- Mixed with any other substance;
- Transferred to a different container or storage vessel;
- Subjected to conditions outside the recommended storage parameters (temperature, humidity, UV exposure).
7. No Warranty
The Company provides no warranty, express or implied, in relation to any product sold, including but not limited to any warranty of merchantability, fitness for a particular purpose, or conformance with any specific application. All products are sold on an “as is” basis. The Buyer assumes all risk associated with the selection, storage, handling, and use of the product(s).
8. Refund Process (Where Approved)
Where a return is approved by the Company under Section 4 and all conditions in Section 5 are satisfied:
- The Company will arrange collection of the goods at its cost, or request the Buyer to return goods at the Company’s nominated carrier;
- Upon receipt and inspection confirming the defect or discrepancy, the Company will, at its sole discretion, offer either a replacement of equivalent goods or a credit note for the value of the goods returned;
- Cash refunds are not automatically available. The Company reserves the right to issue a credit note in lieu of a cash refund;
- Any approved cash refund will be processed within 14 business days of final approval.
9. Order Cancellation
Once an order is confirmed and accepted by the Company, cancellation is not permitted. For orders that have not yet been dispatched, the Buyer may submit a written cancellation request, which the Company will assess at its discretion. Where a cancellation is accepted, a cancellation fee may apply to cover costs already incurred.
10. Limitation of Liability
In all cases, the Company’s total liability in respect of any return or refund claim shall not exceed the invoice value of the specific goods in dispute. The Company shall not be liable for any consequential, indirect, or special losses including equipment damage, loss of revenue, or operational downtime arising from the use or non-use of any product supplied.
